The Tort Law -- Assessing Liability
The tort law has three fundamental goals:
- Victims and their families should be compensated
- Risk should be shifted away from the consumer (or patient) if the dangerousness of the product is not reflected in the price and if the risk
distribution benefits of the shift exceed detriments. The consumer is entitled
to maximum protection at the hands of someone, and the proper persons to afford this protection are the marketers of the product.
- The sale and marketing of unsafe products should be deterred
