Possible Legal Solutions to the Four Hospital Cases
Currently, all medical computer cases are treated the same way under the Tort law, regardless of case complexity and circumstances. The Computer Law Journal offers a suggestion as to how the above four cases should be interpreted:
- Direct -- Product manufacturers should be held strictly liable, providers should be held accountable only under negligence terms.
- Indirect-- Product manufacturers should be held strictly liable, providers should be held accountable only under negligence terms.
- Negligence -- Product manufacturers not liable, providers liable under negligence terms.
- No-fault -- Product manufacturers and providers not liable.
