Conflict Resolution Policy

  • NSI: "neither acts as arbiter nor provides resolution of disputes"
  • Step-by-step:
    1. Complainant files proof of trademark and harm
    2. NSI determines domain's registration date:
      • If domain registered before trademark, then complaint is rejected
      • If domain registered after, NSI requests proof of trademark from registrant; if registrant has a trademark, complaint is rejected
    3. If complainant has trademark earlier than registrant has domain, and registrant has no trademark, then NSI will provide help for registrant to register and move to a new domain name. After 90 days of transition, NSI will place domain on hold
    4. If registrant fails to comply, domain will be placed on hold
    5. If ANY litigation occurs, NSI will leave the domain name as it was when litigation begins, and will only change status on order from court
    6. Hold status will be removed only if NSI is ordered to do so by court, if both parties inform NSI of resolution, or if complainant requests so
  • NSI attempts to mediate in a fairly straightforward way; should courts become involved, then NSI backs out completely
