It is largely unclear how fair use will apply to sculpture models. Currently, the level of effort required not just to create but even to view a high-resolution model makes legitimate end-user purposes for such models somewhat rare. If future devices make 3D scanning approximately as easy as using a camera, copyright holders may have to distinguish between casual and professional reproductions as is currently done with photographs of sculpture.
